Terms and Conditions

Definition of terms

The ‘owner’ is David Williams otherwise referred to as ‘us’ or ‘we’.

The ‘guest’ is the named person who confirmed the booking and arranged the deposit, otherwise referred to as ‘you’ or ‘yours’ and the 'guests are members of the Guest's party.

The ‘property’ is the ‘Loft in the Forest’, otherwise referred to as the ‘loft’ or the ‘accommodation’ – a self contained studio apartment situated above the garage in the grounds of Yew Tree Cottage, Bisterne Close, Burley, BH24 4BA.

The ‘booking form’ is the online booking facility, accessed from our website, and provided by Holiday Bookings Online Ltd.

We have set out as clearly as possible, the conditions under which your booking is made so that you understand the basis of the contract between you and us.

These conditions do not affect your normal statutory rights.

1 Booking

1.1 The accommodation is offered as short term holiday accommodation within the meaning of Paragraph Nine of the First Schedule to the Housing Act 1988 and there is no right of occupancy beyond the stated and agreed period.

1.2 Guests must be at least 18 years old when they book the accommodation.

1.3 We enter in to a contract with you when we issue our written confirmation of your holiday booking which is subject to these booking conditions.

1.4 The guest will assume responsibility for all party members and any dispute or query will rest solely between the owners and the guest.

1.5 We retain the right to refuse any booking prior to the issue of our written confirmation. If we do this, we will write to you and promptly refund any money you have paid us.

1.6 When you receive your booking confirmation from us you agree that you will check the details carefully and immediately notify us of any errors. 


2 Payment

 2.1 Normally a deposit of 50% of the holiday cost will be required at the time of booking and we reserve the right to release your dates if payment has not been received within four working days. The balance will be due six weeks before the holiday start date.(If during a promotion period we accept a reduced deposit then all other terms and conditions will still apply.)

2.2 The full holiday cost will be required for holidays that are booked less than six weeks before the holiday start date.

2.3 Special offers may be withdrawn at anytime and are only applicable whilst they are published on our website. They will not be applicable retrospectively to bookings.

2.4 We will provide bank details for direct bank payments or you may pay both your deposit and balance using a debit or credit card through PayPal. Alternatively you may pay by cheque provided that we receive it at least fourteen days before the holiday start date.  

2.5 We strongly advise all our guests to take out holiday cancellation insurance.

2.6 If you need to cancel your booking, you should inform us in writing, immediately

2.7 Should you cancel your booking we will, if requested in writing by you, make the appropriate dates available for re-booking.

2.8 In the event that we are able to re-let the accommodation we will retain a £50 administration fee and refund  the balance of the money you have already paid. 

2.9 If we do not receive the balance of your holiday booking costs by the appropriate date, we reserve the right to cancel your holiday booking.

2.10 In the unfortunate event that we have to cancel your holiday booking for unforeseen reasons, we will notify you straight away and refund the full amount of the booking. No additional compensation will be payable to you.


3 Accommodation

3.1 The accommodation is designed to accommodate one or two adults only with babies in arms by agreement.
3.2 Pets are not permitted for health and safety reasons.

3.3 The accommodation and the entire grounds of Yew Tree Cottage are non-smoking areas and you agree to abide by this

3.4 You agree to take all reasonable care of the property, furniture, fixtures and fittings. On departure you agree to leave the accommodation in the same clean and tidy condition as on arrival.

3.5 We reserve the right of entry to the accommodation, at any reasonable time, for ourselves or our representatives, for the purposes of inspection, repair or maintenance.

3.6 You agree to give due consideration to others and to keep noise and disturbance to a minimum.

3.7 The accommodation will normally be available for you from 1600 on the first day of your holiday. You are asked to vacate the accommodation before 1030 on your departure day unless you are leaving on Sunday, in which case you are asked to vacate the Loft by 1500.

3.8 We endeavour to ensure that the pictures and description of the accommodation are accurate. Inevitably we may make minor alterations to furniture, fittings and layout. Should it become necessary to make any major changes, we agree to notify you of these.

3.9 We will provide bed linen, bath robes and towels and equip the bathroom with toiletries for use whilst you are staying in the accommodation.

3.10 In the well equipped kitchen area our guests will be provided with an assortment of condiments, and other products to enhance their stay whilst in the Loft in the Forest.

3.11 Guests who use the facilities in and out of the grounds of Yew Tree Cottage (including the outdoor swimming pool and bicycles), do so entirely at their own risk

3.12 The outdoor heated swimming pool will normally be available from June to September depending on the weather and guests are asked to check availability when booking.
